Super Resume Company Limited (the “Company”) is the owner of www.jobtopgun.com, www.superresume.com and www.saywana.com (collectively, the “Platforms”), with the purpose of being a communication channel and creating communities between users, who can be divided into 2 groups: the Job Seekers and the Job Hunters (the “User”).
By using the Platform, the User has read and agreed to comply with this Terms of Services and its amendments (the “Terms”). The Company may amend the Terms at its discretion; amendments take effect upon notification on the Platform, and where a change directly affects the User’s rights or obligations the Company will notify the User. If the User does not accept the Terms, the Company reserves the right to prohibit the User from using the Platforms. If the User continues to use the Platforms after any amendment, the User shall be deemed to have accepted the Terms and all amendments.
The User acknowledges that, apart from these Terms, the Company may need to process the User’s personal data for the purpose of providing the services, and the Company defines the conditions for such processing in the Privacy Notice, which the User shall read and understand prior to using the Company’s services.
1. User Account
1.1 The User shall keep their username and password confidential and shall not disclose such information to any third party. The Company shall not be responsible for any damages arising from the unauthorized use of the User’s username or password by any third party. If there is any unauthorized use, the User shall notify the Company immediately.
1.2 The User accepts that any transactions made through the User’s account with the Company shall be deemed executed by the User and shall bind the User, who shall take responsibility for such transactions.
2. Scope of Services
The User agrees and acknowledges that the Company provides 3 main services (the “Services”) through the Platforms, and by registering a user account the User is entitled to access these Services.
General Use.
For the use of any Services, the Company may offer them free of charge or charge a service fee for any function, and it is the User’s full discretion to decide which Services to use. For Services subject to fees: (a) if the User fails to pay when due, the Company reserves the right to suspend or terminate the User’s use, without prejudice to any other claim for damages under applicable law; and (b) since internet payment of such fees is administered by a third-party vendor (SiamPay), the Company shall not be liable for damages arising where that vendor suspends or withholds the User’s payment, and the Company remains entitled to suspend the User in case of unsuccessful payment.
The Company reserves the right to amend the Terms, adjust Service fees, and add or reduce Platform features; such amendments take effect upon notification on the Platform.
2.1 Services Provided through the Super Resume Platform. The Super Resume platform provides services for Users, as Job Seekers, to create standardised resumes that present the User’s profile attractively and professionally. The services include: (1) recommending topics for a resume via a questionnaire; (2) generating a standardised resume from content the User provides; (3) storing each User’s resume within the system; and (4) disclosing resume data through a system linked to JobTopGun, enabling Job Hunters to review Job Seeker information as displayed on Super Resume. Such disclosure shall not directly disclose a Job Seeker’s personal data unless the User grants permission. In using this platform, Users agree to the following:
2.1.1 True Information. In completing the questionnaire, Users must provide only truthful and accurate information about themselves in all sections. The Company has no duty or liability for the presentation of such information and does not guarantee its accuracy or truthfulness.
2.1.2 Use of Artificial Intelligence. The Company may use Artificial Intelligence to assist in analysing or presenting information about Users, including but not limited to personality assessments, key-characteristic summaries, behavioural signals, or persona summaries, based on information the User submits directly. The User acknowledges and agrees that: (1) such processing is generated by AI from the data the User provides only, with no additional or independent research and no human judgement or verification, and constitutes statistical suggestions only; (2) the results do not constitute a professional personality, psychological or competency evaluation and may be erroneous or incomplete, and the Company makes no representation or warranty as to their accuracy, completeness, reliability or suitability for any purpose; (3) the User retains sole discretion in the final determination of whether the analysis reflects the User’s characteristics; and (4) the Company shall not be responsible for any decision made by Job Hunters or third parties based on AI-generated content, including any indirect damages, loss of employment opportunity, reputational harm, or discriminatory treatment.
2.1.3 Dispute. In any dispute arising from information the User presents through the platform, including AI-generated content the User elects to publish, the User warrants that the Company shall not be liable for any damages any person may claim, and the User shall indemnify the Company for all damages that may arise in connection with the Company and/or the platform.
2.1.4 Company’s Right to Review. The User acknowledges that the Company has the right, but not the obligation, to review the accuracy of submitted information. If the Company finds information inaccurate, it may, at its sole discretion, delete, suspend services, or suspend publication of the relevant User’s Super Resume for verification or to prevent damage, and the User shall have no right to claim damages. The Company’s failure to exercise this right is not a waiver of its right to review later.
2.1.5 AI persona and behavioural analysis. Where the Platform displays a persona, behavioural-signal, strengths or talent analysis of the User, such output is an automated inference derived solely from the data the User has entered. It is not a measure of the User’s true character, integrity or future performance, is provided for informational purposes only, and must not be treated as a final or decisive assessment. The User may, at any time, edit the underlying data, request human review, or object to the AI analysis through the channels in the Privacy Notice.
2.2 Services Provided through the JOBTOPGUN Platform. The JOBTOPGUN platform is an intermediary for communication and matching between job-advertisement requirements posted by Job Hunters and the work-history profiles provided by Job Seekers, whether submitted directly or through Super Resume. The Company shall: (1) compile Job Hunter advertisements and Job Seeker work histories; and (2) display both parties’ information so each may select and contact the other. Through the Company’s systems, the Company may present matching suggestions for convenience. In using this platform, Users agree to the following:
2.2.1 Company’s Intermediary Role. Both Job Seeker and Job Hunter Users agree that the Company merely presents job-advertisement information or work-history profiles. Users who submit or publish information about themselves — whether directly or as generated/presented through the Company’s systems, including AI-generated content — are solely responsible for its accuracy. The Company does not guarantee or verify any information displayed. In any dispute over such content, the relevant User is solely responsible and shall indemnify the Company in full. If a User encounters an issue with another User’s content, they may report it, and the Company may handle it at its discretion; the User shall have no right to claim damages from the Company.
2.2.2 Matching Suggestion. Both Users agree that the Company merely provides matching suggestions — including AI-generated candidate suggestions, “Top Picks” rankings, best-match scores and “why fit” summaries — reflecting similar characteristics only. Any such AI ranking or score is generated from job-seeker-provided data only, involves no additional research, judgement or guarantee, and is provided for the Job Hunter’s preliminary HR information only. For the avoidance of doubt, the decision to make contact, and the decision to hire or not to hire, or to perform any employment agreement, are the independent decisions and actions of both User parties. The Company has no involvement in, or liability for, such matters.
2.2.3 No Guarantee. The Company does not guarantee the success of any User’s use of the Services. It does not guarantee that every Job Seeker will secure employment, nor that every Job Hunter will find a suitable candidate, and shall not be liable for any such failure.
2.2.4 No sole reliance; non-discrimination. A Job Hunter must not make any recruitment decision based solely on AI-generated output and must independently verify candidate information before deciding. The Job Hunter shall not use AI output in any manner that unlawfully discriminates against a candidate, and is solely responsible for compliance with the PDPA and applicable labour and anti-discrimination laws when processing candidate data obtained through the Platform.
2.3 Services Provided through the Saywana Platform. The Saywana platform creates a network community for Job Seekers with similar work details (as shown on Super Resume) to communicate and give career-development advice in an academic and professional manner. For this platform, the Company shall (1) allow Job Seekers to create a profile page featured on a public post of Saywana, with the User able to choose privacy settings; (2) recommend Job Seekers with similar interests or work details to contact one another; (3) provide a platform to share stories or content among connected Users; and (4) act as a channel to promote User-initiated programs or activities. In using this platform, Users agree to the following:
2.3.1 Communication Channel Function. Company only provides a communication channel for Users with similar interests in professional development, based on User information on Super Resume or the profile created on the platform; the decision to contact one another is the User’s sole discretion and the Company is not involved.
2.3.2 Key purpose — professional development. If any User uses the platform for a purpose other than that defined by the Company, such communication is deemed conducted solely by the Users and the Company shall not be liable for any resulting damages.
2.3.3 Information provided by the User. Information displayed through Saywana is submitted by the User. The Company has no obligation to verify a profile page or any content in feeds. The User is solely responsible for accuracy and agrees to be responsible for damages or claims against the Company.
2.3.4 Disputes. Any dispute between Users over content exchanged or expressed through the platform shall be settled directly between the Users, who shall not claim damages from the Company. The Company may set guidelines for expression, and if a User does not comply, the Company may suspend or delete the content to reduce impact, with no right for the User to claim damages.
2.3.5 User-organised activities. If Users organise professional-development activities or programs and announce them on the platform or network, the relevant Users are responsible for those activities among themselves, and acknowledge the Company is not involved or responsible.
3. User’s Term of Services
3.1 The User agrees to use the Platforms only for lawful purposes and in accordance with the purpose of each Platform as stated in writing by the Company.
3.2 The User agrees not to present or upload the following content; and if the Company considers any content to violate this clause, it may deny, reject, modify or delete it at any time without prior notice and without responsibility for any resulting loss:
- a) Content that is illegal, unethical, defamatory, obscene, discriminatory, and/or violates the rights of others, or contains provocative or violent words, or intentions outside the Services such as attacking competitors or supporting illegal acts.
- b) Content that is false or imitative, or any act suggesting the User is an officer, employee, agent or authorized representative of the Company or another User, for any reason.
- c) Content that infringes the intellectual property or proprietary rights of others.
- d) Content containing viruses, computer code, files or programs designed to interrupt, damage or limit the Platforms or other Users.
- e) Content that is an unauthorized solicitation such as junk mail, spam, pyramid scheme, or any invitation contrary to law.
3.3 The User shall not use screen scraping, data mining, robots or similar techniques on the Platform to establish, maintain, develop or reproduce information for any purpose, except with the Company’s prior written consent.
3.4 The User represents and warrants that it is a natural or juristic person with the right to transact under applicable law, and that the information provided is true and accurate. If the User is under 18, they must confirm that their legal guardian has consented. If the Company finds a breach of this clause, it may suspend and cancel the User’s account without prior notice, and the User shall have no right to claim damages.
3.5 The Company reserves the right to suspend or terminate Services relating to insurance agents/brokers, multi-level (MLM) business, face-to-face direct sales and similar businesses, and job advertisements that are vague, inappropriate or suspicious, immediately and without prior notice, with no right for the User to claim damages.
3.6 Job Hunters allow the Company and its affiliates to use their company name and logo to promote them as clients of the Company or Platform, and agree that the Company may disclose Platform-usage information for commercial or marketing purposes at its discretion. This right continues after termination of the Services, provided the Company complies with its Privacy Policy.
3.7 If a Job Hunter purchases additional services, it shall comply with these Terms and the specific terms of that additional service, which the Company will provide with a quotation.
3.8 The User shall not print, download, remake, copy, reproduce, forward, republish or use any information that could identify another User, except as allowed by the Company on each Platform and with the relevant User’s written consent.
3.9 In providing the Services, the Company may, at its discretion, report or notify relevant authorities of any User conduct that the Company considers, or may consider, improper or contrary to law or good morals, without prior notice to the User.
4. Protection of the Intellectual Property
4.1 All content on the Platforms — including information, messages, graphics, pictures, layouts, designs, images, logos, editorial content, homepage language, HTML documents and other proprietary materials (the “Platform Content”) — is the intellectual property of the Company. The Company reserves all rights to enforce its intellectual property, including against any infringing User.
4.2 The User shall not, nor engage any third party to, copy, reproduce, share, publish, distribute, store (in any form), display, modify, sell, transfer, offer for sale, create derivatives of, or otherwise benefit from the Platform Content, in whole or in part.
5. User’s Liability
To the fullest extent permitted by law, the User agrees to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, agents, proprietors, partners, representatives, shareholders, servants, attorneys, predecessors, successors and assigns from any claims, actions, demands, injuries, liabilities, losses, damages, costs and expenses (including legal fees on a full-indemnity basis) arising from or relating to the User’s non-performance of these Terms or any third-party claim against the Company. This indemnity is in addition to the User’s other obligations and does not prejudice the Company’s other rights or remedies.
6. Limitation of the Company’s Liability
6.1 The Company is not a representative or agent of any User for the Services and shall not be responsible for any decision made by a User for any reason. The Company is likewise not responsible for any content not posted directly by it; each User is responsible for the form and accuracy of the content it presents through the Platform.
6.2 To the fullest extent permitted by law, the Company, its affiliates, directors, employees or representatives shall not be liable for any damages arising from a User’s use of the Services, except damages arising directly from the Company’s willful misconduct or gross negligence, and shall not be liable for indirect or consequential damages of any kind.
6.3 The Services are provided on an ‘as-is’ basis only. To the fullest extent permitted by law, the Company expressly disclaims all representations and warranties regarding the Platform (including any output, ranking, score, persona or analysis generated by Artificial Intelligence technology) and its components, including: (1) merchantability or fitness for the User’s particular purpose; (2) that the Platform will operate without delay, interruption, inaccuracy, downtime or technical error; (3) that the Platform is secure and free of viruses or harmful components; and (4) that all content presented is accurate, correct and reliable and free of any third-party rights violation.
6.4 To the fullest extent permitted by law, the Company, its affiliates, employees, directors or representatives shall not be liable for any damages resulting from the User’s misuse of the Services or any force majeure.
6.5 Unless otherwise stated in these Terms and to the fullest extent permitted by law, the Company’s aggregate liability for claims relating to the Services or the Platform shall be limited to the total Service fees received by the Company giving rise to such claim.
6.6 The Platform may link to third-party websites over which the Company has no control or involvement, and the Company shall not be liable for any damages arising from the User’s use of such third-party services.
7. Miscellaneous
7.1 These Terms are governed by and construed under the laws of Thailand. Any dispute in connection with the Terms shall be settled by arbitration under the current Arbitration Rules of Thailand.
7.2 Each provision applies separately. If any provision is held illegal, void or unenforceable, the remaining provisions remain in full force and effect.
7.3 These Terms are written and agreed in Thai and have been translated into English. In case of any inconsistency between the Thai version and the English translation, the Thai version shall prevail for interpretation.
7.4 The User confirms that the email address specified on the Platform is one at which the User can be reached at all times. Any communication, letter or notice the Company sends to that email is deemed a valid notice, and the User is deemed to have received it on the date it is sent.
7.5 Unless the Company specifies otherwise in writing, these Terms constitute the entire agreement between the User and the Company regarding use of the Platform, and supersede all prior communications, discussions, correspondence and agreements (written or oral) on the subject matter.
